Summary

This provision of the Maine Constitution provides that the State of Maine shall assume and perform all the duties and obligations of Massachusetts towards the Indians within Maine, whether the same arise from treaties, or otherwise.

Fifth. The new State shall, as soon as the necessary arrangements can be made for that purpose, assume and perform all the duties and obligations of this Commonwealth, towards the Indians within said District of Maine, whether the same arise from treaties, or otherwise;

The Maine Indian Tribal-State Commission (MITSC) is an inter-governmental entity created by the Maine Implementing Act of 1980. Six members are appointed by the State, two by the Houlton Band of Maliseet Indians, two by the Passamaquoddy Tribe, and two by the Penobscot Indian Nation. The thirteenth, who is the chairperson, is selected by the other twelve.
