Applicability of Federal Laws

The federal Settlement Act contains two provisions that limit the application in Maine of federal laws for the benefit of Indians if those laws are deemed to interfere with State jurisdiction as defined in the Settlement. These provisions have proven to be controversial. The Wabanaki Tribes have maintained that the limiting provisions have been over-applied to the detriment of the Tribes and their citizens. Several proposals have been made to remove or modify the limitations.
